Evoluer Fitness, LLC is a Maryland Limited Liability Company doing business as “Evoluer Fitness.” In this agreement, “Evoluer Fitness,” “we,” “us,” or “our” refers to Evoluer Fitness, LLC. The term “Platform” refers collectively to our website (www.evoluerfitness.com), mobile applications (powered by Trainerize), sub-domains, and any services or content provided through them.

Introduction

Welcome to Evoluer Fitness! These Terms of Service (“Terms”) govern your access to and use of our Platform and Services. By accessing or using our Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use our Services.

You represent that you are at least 18 years old, or that you are using the Service under the consent and supervision of a parent or guardian.

Description of Services

Evoluer Fitness provides a range of fitness and wellness services, including:

• Online Fitness Programs via mobile app (workouts, habit training, nutrition programs).

• Downloadable E-books and Guides for fitness and nutrition.

• Community Features including a private Facebook group and in-app community chat where members can share progress, posts, photos, and videos.

• Apparel and Merchandise available for purchase.

• In-person Personal Training Sessions (if applicable). These are governed by separate agreements and waivers in addition to these Terms.

We may add, modify, or discontinue features or offerings at our discretion.

Account Creation

• You must register for an account to access subscription features.

• You agree to provide accurate and current information and to safeguard your login credentials.

• You are responsible for all activity under your account.

• You must complete required onboarding forms, including a PAR-Q and waiver.

Payment Terms

• Free Trial: New users receive a 7-day free trial. If you do not cancel before the trial ends, your account will automatically convert to a paid subscription.

• Subscription: Monthly subscription of $29.99 USD, billed in advance, processed through Stripe.

• Auto-Renewal: Subscriptions automatically renew each month until canceled.

• No Refunds: All payments are non-refundable, except as required by law.

• Cancellation: You may cancel at any time via account settings or by emailing info@evoluerfitness.com. Cancellation takes effect at the end of the current billing cycle.

User Obligations

You agree to:

• Use the Platform in compliance with laws and these Terms.

• Provide accurate health information and consult a physician before beginning any fitness program.

• Treat other members respectfully in community features.

• Not share, copy, or distribute Evoluer Fitness content without our consent.

• Not engage in harassment, illegal conduct, impersonation, spamming, or distribution of harmful code.

Assumption of Risk & Disclaimer

Participation in fitness activities carries inherent risks, including injury, illness, or death. By using our Services, you acknowledge and assume these risks. Evoluer Fitness is not a medical provider and our content is not medical advice. Consult a physician before starting any program.

You release Evoluer Fitness, its employees, and agents from any liability related to your participation, except in cases of gross negligence or willful misconduct.

Intellectual Property

All content provided by Evoluer Fitness (workouts, nutrition plans, e-books, videos, guides, and trademarks) is the exclusive property of Evoluer Fitness, LLC. You may use content solely for your personal, non-commercial purposes. Unauthorized sharing, reproduction, or distribution is prohibited.

Community Features

You may post content (messages, photos, videos) in community features. You retain ownership of your content but grant Evoluer Fitness a license to use, display, and share it within the Platform. Content that violates these Terms may be removed.

Third-Party Services

The mobile app is powered by Trainerize and distributed through the Apple App Store and Google Play. Apple and Google are not responsible for Evoluer Fitness services or support. Payment processing is provided by Stripe, which has its own terms of service.

Termination

We may suspend or terminate your account for violations of these Terms, illegal activity, or other harmful conduct. You may terminate your account at any time by contacting us.

Certain provisions (intellectual property, limitation of liability, indemnification, etc.) survive termination.

Limitation of Liability

To the fullest extent permitted by law, Evoluer Fitness is not liable for indirect, incidental, or consequential damages, including injuries from participation in programs. Our maximum aggregate liability is limited to the greater of $50 or the amount you paid us in the six (6) months prior to the event giving rise to the claim.

Dispute Resolution

• Governed by Maryland law.

• Parties agree to first attempt mediation.

• If unresolved, disputes shall be resolved by binding arbitration on an individual basis.

• Class action waivers apply.

• Exceptions: small claims court or intellectual property disputes.

Amendments

We may update these Terms at any time. Continued use of the Platform after updates constitutes acceptance of the revised Terms.

Severability

If any part of these Terms is found invalid, the remainder shall continue in full force and effect.

Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and Evoluer Fitness.
